1. Platform Overview
Home & Post operates solely as a digital marketplace connecting realtors ("Users") with independent contractors ("Contractors") who provide signpost installation, removal, and related property marketing services. We do not perform or supervise any physical services and are not a party to service agreements between Users and Contractors.
2. Account Registration & Eligibility
To create an account, you must be at least 18 years old and provide accurate, complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. We reserve the right to suspend or terminate accounts that violate these Terms or present risk.
3. Payment Processing (Stripe)
Payments are processed via Stripe. By using the Platform you agree to the Stripe Services Agreement and Connected Account Agreement available at stripe.com/legal. We do not store full payment credentials. Stripe may withhold or delay funds subject to compliance reviews or risk mitigation.
4. Fees & Payouts
Each booking includes: (a) contractor service price; and (b) a platform fee retained by Home & Post. Platform fees are generally non-refundable except where required by law or explicitly stated. Contractor payouts are disbursed through Stripe according to its schedules and policies.
5. Independent Contractor Relationship
Contractors are independent providers—not employees, partners, joint venturers, or agents of Home & Post. Users contract directly with Contractors and are responsible for assessing suitability and compliance with local laws.
6. Cancellations & Disputes
Cancellation policies may vary per service category. Users and Contractors should attempt good-faith resolution of disputes. We may (but are not obligated to) facilitate resolution; any participation is discretionary and does not waive legal disclaimers.
7. Acceptable Use
- No misrepresentation of identity or affiliations.
- No uploading of unlawful, fraudulent, defamatory, or infringing content.
- No interference with Platform security, integrity, or infrastructure.
- No reverse engineering, scraping, or unauthorized automated access.
8. Limitation of Liability
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Home & Post disclaims all warranties, express or implied. We are not liable for indirect, incidental, consequential, or punitive damages, or for Contractor performance issues. Aggregate liability shall not exceed the total platform fees you paid in the preceding six (6) months.
9. Indemnification
You agree to defend, indemnify, and hold harmless Home & Post, its affiliates, officers, directors, employees, and agents from claims arising out of (a) your use of the Platform; (b) violation of these Terms; or (c) interactions with other users or Contractors.
10. Affiliate Program
Affiliates earn a 20% commission on platform fees for qualifying transactions driven via approved referral links or codes. Commissions are earned on transactions placed by or to referred users for a period of 2 years from the date of referral signup. This includes orders placed by referred customers and orders placed to referred service providers.
Payouts are processed monthly with a minimum payout threshold of $50.00. Commission eligibility expires 2 years after the referred user's signup date. Participation requires compliance with anti-spam, disclosure, and brand usage standards. Additional program rules are defined in our Affiliate Program Guidelines, which may be updated periodically. Taxes on earnings are solely your responsibility.
11. Modifications
We may revise these Terms at any time. Material changes will be indicated by an updated "Last Updated" date. Continued use after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the State of Florida, excluding conflict-of-law rules. Venue for disputes lies exclusively in the state or federal courts located in Brevard County, Florida.
